It is hereby promulgated that the Measures of Wuhan Municipality for the Administration of Examination and Approval of Green Areas of Construction Projects have been adopted at the 118th Executive meeting of Wuhan Municipal People’s Government on January 23, 2015, and shall be implemented as of April 1, 2015.

Measures of Wuhan Municipality for the Administration of Examination and Approval of Green Areas of Construction Projects

 

Article 1   With a view to regulating the administration of examination and approval of green areas of construction projects within this Municipality, these Measures are formulated in accordance with the Regulations of Wuhan Municipality on Urban Greening and the Regulations of Wuhan Municipality on Urban and Rural Planning, and in the light of the actual situation of this Municipality.

Article 2   These Measures are applicable to the administration of examination and approval of green areas of construction projects within the urban planning area of this Municipality.

Article 3   For the construction projects approved by the municipal department of planning, the municipal department of landscape shall be responsible for the administration of examination and approval of their green areas. For the construction projects approved by the district departments of planning, the district departments of landscape shall be responsible for the administration of examination and approval of their green areas.

The government departments concerned shall perform the work related to the administration of examination and approval of green areas of construction projects in line with their respective responsibilities.

Article 4   A department of landscape shall, in accordance with these Measures, examine the supporting green area during its examination over a construction project plan, and deliver its comments to a department of planning within five working days.  

A department of landscape shall, during its verification of the planning and design conditions of a construction project, supervise and examine the supporting greening works, and deliver its comments to a department of planning within five working days.

Article 5   The total land area of a construction project is subject to the range approved on its Construction Land Use Permit. For a construction project of which the Construction Land Use Permit has not been obtained, its total land area is subject to that confirmed under the planning and design conditions.Article 6   The green ratio of a construction project shall meet the standard provided under Article 18 of the Regulations of Wuhan Municipality on Urban Greening. If the aforementioned standard is not practical due to factual restrictions, the green ratio of a construction project  may, after being reviewed by the department of landscape and approved by the people’s government at the same level, be lowered appropriately to not less than 70% of the specified standard.

The green ratio of a construction project with compatible land use shall be determined by the weighted average of the proportions of land parcels of different categories. If the areas of land parcels are not clear, the weighted average of the proportions of floor areas of different categories shall be taken. Article 7   A department in charge of the examination and approval of construction projects shall, during its preliminary review of an urban greening project such as road greenbelts, examine the design scheme jointly with a department of landscape in accordance with the relevant technical standards and codes and with consideration of the site conditions, and thereafter the developer shall require the design institute to optimize its design scheme based on the review comments.

Article 8   The supporting green lands of a residential project shall be demarcated as follows:

(1) The boundaries of public green lands beside the paths among buildings, cluster paths or community roads shall start from one meter off the paths or roads, and the boundaries of green lands beside the buildings shall start from the roadside;

(2) The boundaries of green lands beside the community sidewalks shall start from the side of sidewalks;(3) The boundaries of green lands beside the urban roads or the roads of residential s shall start from the boundary lines of such roads;

(4) The boundaries of green lands beside the buildings shall start from 0.9 meters off the foot of building walls; and

(5) The boundaries of green lands beside the enclosure walls or courtyard walls shall start from the foot of walls.

Article 9   The public green lands of a residential project (including the central green land, public greenbelts and parcels) shall comply with following provisions:

(1) The area of central green land shall not be less than 10,000 square meters for a residential project at the residential district level, not less than 4,000 square meters for a residential project at the community level, and not less than 400 square meters for a residential project at the cluster level;(2) The area of public greenbelts and parcels shall not be less than 400 square meters, and the width not less than 8 meters;

(3) At least one side of the central green land as mentioned in Item (1) shall be adjacent to the road at the corresponding level, with an open layout;

(4) The green area (including the water surface) shall not be less than 70%; and

(5) Other requirements specified under the Code for the Planning & Design of Urban Residential Districts.

The distance from the north boundary of a public green land to the south boundary of a benchmark building shall not be less than 1.5 times the height of such benchmark building. A building adjacent to the south of a green land and seated in the due north-south direction shall be taken as the benchmark building. If the building in the south is not seated in the due north-south direction, the aforesaid distance shall be calculated by the interval reduction coefficients of different directions.

Article 10   The green area of a construction project shall be calculated as follows:

(1) For a separate artificial waterscape, 30% of its area shall be taken as the green area; however, such converted green area shall not exceed 10% of total green area;

(2) For an arbor planted separately, the actual area of its tree pool shall be taken as the green area; for arbors planted in a line which consists of five or more arbors with a spacing of less than five meters, the green area shall be calculated by multiplying the actual planting length and the average pit width; for arbors with trunk diameter of eight centimeters or larger and planted in a matrix which consists of four or more arbors in each line and row with a spacing of less than five meters, the whole area of the matrix shall be taken as the green area; and

(3) For vertical greening using a planting groove with width of 0.5 meters or larger, the area of the planting groove shall be taken as the green area; for vertical greening not using a planting groove, 40% of its actual vertical area shall be taken as the green area.

Article 11   For the earth sheltered greening on the top of a building (structure) whose roof elevation is lower than the surrounding existing urban road, the green area shall be calculated as follows:

(1) For earth sheltering with thickness of 1.0 meter or  over, 80% of its actual area shall be taken as the green area; 

(2) For earth sheltering with thickness between 0.6 meters to 1.0 meter, 65% of its actual area shall be taken as the green area; and

(3) For earth sheltering with thickness under 0.6 meters, 30% of its actual area shall be taken as the green area.

Article 12  For the earth sheltered greening on the top of a building (structure) whose roof elevation is higher than the surrounding existing urban road, with average thickness of or above 0.4 meters, 30% of its area shall be taken as the green area; however, such converted green area shall not exceed 20% of total project green area.

Article 13   For a parking lot paved with grass grids, 25% of its area shall be taken as the green area.

If, in a parking lot paved with grass grids,  a shade arbor  with trunk diameter of eight centimeters or larger is planted in each parking space, 40% of its area shall be taken as the green area.

Article 14   The following shall not be included into the green area of a construction project:

(1) balcony greenery, indoor greenery, potted flowers and plants, flower stands and beds on walls and railings; and

(2) fire lanes, elevating platforms, etc.

Article 15   A developer shall carry out greening works as approved by a department of landscape, and after completion of the works, entrust a qualified survey agency to organize a field measurement.

A department of landscape shall strengthen its supervision and administration over the greening works of a construction project and deliver its comments on the works made based on the aforementioned field measurement to a department of planning; and the latter shall, during its verification of the planning conditions, determine whether the green ratio of a project reaches the standard in the light of the comments.

Article 16   If a developer fails to carry out greening works as approved by a department of landscape, and the actual completed green area is less than that approved, a department of landscape shall order such developer to make corrections within a prescribed time limit; if a developer fails to make corrections within the prescribed time limit, it shall be punished as follows:

(1) If the gap is less than 5% of the approved green area, a developer shall pay the greening compensation as per the gap; or

(2) If the gap is more than 5% of the approved green area, a developer unit shall be fined not less than 3 times but not more than 5 times the greening compensation as per the gap.

Whoever occupies a supporting green land without authorization or damages the greening of a construction project shall be punished in accordance with the Regulations of Wuhan Municipality on Urban Greening.

Article 17   These Measures shall come into force as of April 1, 2015. Meanwhile, the Measures of Wuhan Municipality for the Calculation, Examination and Approval of Green Areas of Construction Projects (WMG [2005] No. 35) promulgated on July 15, 2005 shall be repealed therefrom.
